MGA proposes AI Gaming Charter for safe AI use in gambling

MGA has launched a public consultation on a new AI Gaming Charter. The framework is set to promote ethical and responsible use of AI in gambling.

The Malta Gaming Authority has launched a public consultation on a proposed AI Gaming Charter set to guide the responsible use of artificial intelligence (AI) in the gambling sector.

The charter is designed to sit alongside the EU's landmark AI Act and fill in the gaps specific to online gambling, with the goal of getting more accountability, transparency, and safety within the industry.

The reality of AI in gambling

AI adoption in gaming has increased. We find more and more operators using it for everything, such as customer support, compliance monitoring, fraud detection, and even marketing. AI even helped transform responsible gambling efforts.

Despite that it's a great resource to boost efficiency, AI poses many risks to modern gambling as well. These include bias, misuse of customer data, and a lack of transparency.

The MGA wants voluntary, principle-based guidance in place before those risks become enforcement problems. And once again, the regulator is taking the lead in what could potentially be huge changes for the whole industry.

The AI Gaming Charter

Recently, MGA introduced the first dedicated AI governance framework. Now, the authority is proposing this new AI Gaming Charter to further improve transparency, accountability, and player protection without stifling innovation.

The charter is being developed in collaboration with the Malta Digital Innovation Authority (MDIA). The MGA has clearly stated that this document is not intended to replace the existing legislation, which includes the EU's AI Act.

It’s there to provide industry-specific guidance for operators who integrate AI into the different verticals of their business.

Where it fits with the EU AI Act

The EU’s AI Act is the first of its kind. This comprehensive legal framework specifically created for artificial intelligence is there to ensure trustworthy, human-centric AI.

The Act came into force in August 2024 and will be fully applicable by August 2026. The Act itself has positioned Europe as a pioneer in terms of AI governance.

It works by sorting AI systems into four risk categories: unacceptable risk (banned since February 2025), high risk (strict obligations), transparency risk (disclosure rules, in effect from August 2025), and minimal to no risk (no specific rules).

The AI Act has set a global benchmark for AI regulation as it balances innovation with consumer protection. The MGA’s AI Gaming Charter is proposed as a means to complement the existing legislation rather than overtake it.

This means that it will address AI usage specifically in gambling context, e.g., regulate its behaviour when it flags problem gambling patterns or when it decides which bonus to offer to players.

What does the industry have to say?

The MGA has been known to rely on consultation-based regulatory development for more open dialogue and transparent policymaking. As the proposal is in its public consultation phase, operators, stakeholders, and other industry professionals were invited to submit their feedback.

According to industry analysts, the process is worth watching beyond Malta. The consultation can serve as an early indication of how other regulators will approach AI oversight, now that EU casinos and operators worldwide have embraced AI-driven systems.

What's even more important is that even though the charter is aimed at operators, its impact will fall on players and responsible gambling, nevertheless. As a result, it could mean clearer rules for AI usage or more accountability if that goes wrong.
