History of gambling in Peru

Peru only made its first steps towards online betting regulation as the activity grew in popularity, especially during COVID-19. This led to discussions and Congress creating a framework very similar to land-based regulation. Their major concerns revolved around tax evasion, player safety, and money laundering risks.

In 2022, Peru became one of the first Latin American countries to pass a dedicated online gambling law, Law No. 31557. With the new law came the establishment of MINCETUR, the regulatory authority. As well as the introduction of licensing requirements for remote betting and online casinos.

SUNAT is the tax authority that administers gambling-related taxes, and the Directorate of Casino and Slot Machines (DGJCMT) is a division in MINCETUR that handles online gambling authorisations.

No law is perfect, and Law No. 31806 adjusted the framework to make room for international casinos to enter the market and offer their services to locals.

It also brought clearer rules regarding compliance, taxation, and penalties on unlicensed betting action. Supreme Decree No. 005 - 2023 - MINCETUR brought technical standards, responsible gambling measures and an enforcement mechanism.

2024 was another busy year with Peru’s regulated online gambling market officially opening. And in March 2024, MINCETUR received over 140 licensing applications. A promising sign of interest from local and international operators.

Between 2024 and 2025, they also introduced a selective consumption tax (ISC) and AML/CFT obligations under SBS resolutions.

Current regulations

The first thing to understand is the regulatory authority behind the gaming market in Peru. There are three names you need to know:

MINCETUR (DGJCMT division) - Deals with licensing, approves labs, enforces sanctions and sets technical standards.
SUNAT - This is the tax authority that administers gambling taxes.
Superintendencia de Banca, Seguros y AFP (SPS) - This is the body responsible for AML/CFT compliance.

Based on these rules, every online casino and sportsbook operating here needs a MINCETUR licence. Licensing lasts 6 years, but can be renewed after that. At the start of 2026, 91 authorisations were granted, and there are about 50 active gambling platforms.

All operators are expected to run SPLAFT systems, identify players, and monitor transactions that go over $2,500. Staff must be trained yearly, and platforms are also responsible for enhanced due diligence for higher-risk clients.

Any platforms that are non-compliant may face licensing suspension or revocation, domain blocking, fines and even criminal exposure.

What is the SPLAFT System?
